Alabama Scrap Laws

HB 278 - Effective 2012 Alabama State Requirements

According to Alabama scrap laws, dealers must maintain records of transactions on site for a minimum of one year.  They are prohibited from paying cash for sales of copper, air conditioners or parts of catalytic converters exceeding $50 and for sales of all other material exceeding $500.  Checks must be made payable to the name and address of the seller and be mailed to his or her recorded address or picked up by the seller.  There is a 15-day tag-and-hold policy when no­tified by law enforcement.  It is unlawful to purchase or possess any scrap wire, pedestalor other equipment marked as belongingto any public utility, government entity, railroad, school, graveyard or private business without written proof that the seller is entitled to sell such materials.

In order to sell scrap metal in the state of Alabama, sellers will be required to:

• Sign a statement indicating they are the owner or are authorized to sell the scrap metal
• Sign a statement that they have not been convicted of scrap metal theft
• Provide a copy of state ID card or driver's license
• Provide finger print

Buyer's will be required to:

• Record time/date stamp image or video of the seller and the scrap material being sold
• Record make, model, type of vehicle, and state of issuance and license plate number of sellers vehicle used to transport scrap
• Keep record of sellers name, date of sale and address
• Sales tickets must have initials of the employee completing the sale, along with date and time of sale
• Show the amount paid for material
• Tag and hold policies are in effect
• Tickets must be signed by seller.  Each party receives a copy of receipt
• Buyer must report purchased vehicle information to NMVTIS
